Terms of Use

1. Purpose and acceptance
These Terms of Use (hereinafter “the Terms”) govern access to and use of the Casa Croqueta service, available at casacroqueta.fr (hereinafter “the Service”), published by Valérian ZOLTOWSKI, sole trader registered under SIRET 984 210 625 00013, operating the Service under the trading name Casa Croqueta (hereinafter “the Publisher”).
By creating an account or using the Service, the user (hereinafter “the User”) accepts these Terms without reservation. If the User does not accept them, they must stop using the Service immediately.
2. Description of the service
Casa Croqueta is a recipe-management application that lets users create, organise, share and explore recipes. The Service includes:
- Creating and managing personal recipes;
- Sharing recipes (private, by link, or public);
- Exploring a community of recipes;
- Premium features subject to a paid subscription (see the Terms of Sale).
The Publisher reserves the right to modify, suspend or discontinue all or part of the Service at any time, with reasonable notice except in an emergency.
3. Registration and user account
Access to the Service requires creating an account with a valid email address and a password. The User undertakes to:
- Provide accurate information and keep it up to date;
- Keep their login credentials confidential;
- Notify the Publisher immediately of any unauthorised use.
Each person may create only one account. Creating multiple or fake accounts is prohibited.
4. User content
4.1 Rights retained
The User retains all intellectual property rights in the recipes and content they create. The Publisher claims no ownership over that content.
4.2 Display licence
By making a recipe public, the User grants the Publisher a non-exclusive, royalty-free licence, worldwide and for the duration of the publication, covering the right of communication to the public only, for the purposes of:
- displaying it on the Service and in its search and discovery features;
- quoting it, together with the User's name, in the Publisher's communications about the Service, including on its social media accounts.
This licence carries no right of modification, adaptation, translation or sub-licensing. It ends as soon as the content is removed or made private; the Publisher then ceases any new use, it being understood that publications already distributed on third-party services cannot always be withdrawn by the Publisher. The User's name is credited on every use, in accordance with their right of attribution.
4.3 Prohibited content
It is prohibited to publish content that is:
- Unlawful, defamatory, hateful or violent;
- Infringing on third-party rights (copyright, trade marks, personal data);
- Misleading or fraudulent;
- Containing malware or phishing attempts.
The Publisher reserves the right to remove any non-compliant content and to suspend or close the offending User's account.
4.4 Recipes created with the writing assistant
The Service offers an assistant that sorts a pasted text or a photographed page into the fields of a recipe. This assistant transcribes and organises; it does not rewrite your text. Where a piece of information is absent from your source but can be inferred from it — a preparation time calculated from the steps, for example — the assistant offers it to you explicitly flagged as inferred, and you can clear it. No value is saved without you having seen it. For what the assistant transmits to a provider, see the privacy policy.
The published recipe is the User's work, and the User is responsible for it.By publishing a recipe taken from a source they did not write — a book page, a third-party website, someone else's publication — the User declares that they hold the necessary rights or have rewritten it in their own words.
An ingredient list and a sequence of operations are, in principle, not protected by copyright: they bear nobody's personal stamp. It is the wording that is — the turn of phrase, the commentary, the layout — and it is that wording the User undertakes not to reuse. Also protected, independently of the recipe itself: photographs, page layout, and the collection as a whole. Reproducing a substantial number of recipes from a single work infringes its publisher's rights, even where each recipe taken alone would not be protected.
The assistant can be wrong. The User remains the sole judge of the accuracy of what they publish: quantities, cooking times, allergens.
4.5 Reporting and takedown
The Service hosts content published by its Users. Anyone who believes a piece of content infringes their rights may report it, through the report button on every public recipe — reason “rights infringement” — or by email at support@casacroqueta.fr.
A report is best accompanied by:
- the address of the recipe concerned;
- the work or right being invoked;
- the claimant's contact details.
The Publisher reviews reports and removes the content concerned without undue delay. Every takedown is reasoned, notified to the author, and traced. Removed content is not deleted: it stops being published and remains accessible to its author.
The Publisher acknowledges every report that includes contact details, and informs the reporter of the decision taken and of the redress available against it. Reports sent by email receive the same treatment as those made from within the application.
Contesting a decision. Whether you are the author of removed content or a reporter whose claim was dismissed, the decision can be contested by writing to support@casacroqueta.fr, quoting the recipe title. The review is carried out by a person. Bringing the matter before the competent court remains open at any time.
4.6 Content moderation
The Publisher applies the following measures:
- an automated check of the text produced by the import assistant, before any display. Text amounting to hateful, violent or sexual content, incitement to self-harm, or the description of an unlawful activity is refused: no draft is produced and no page is charged. This check is fully automated and can get it wrong; a review by a person may be requested at support@casacroqueta.fr;
- a completeness check on publication: a public recipe missing essential elements is not published and is returned to you with the list of what is missing;
- an automated analysis of published recipes, which may delay or refuse a publication. Private recipes are not subject to it;
- a human review of reported content, under the terms of article 4.5.
The Publisher carries out no general monitoring of published content and is under no obligation actively to seek out unlawfulness, in accordance with Article 8 of Regulation (EU) 2022/2065.
5. Acceptable use
The User must not, in particular:
- Access the Service by automated means (bots, scrapers) without authorisation;
- Attempt to circumvent security measures;
- Disrupt the operation of the Service;
- Resell or sub-licence access to the Service.
6. The Publisher's intellectual property
The Service, its interface, source code, trade marks and logos are the exclusive property of the Publisher and are protected by intellectual property law. Any unauthorised reproduction or extraction is prohibited.
7. Availability and maintenance
The Publisher endeavours to keep the Service available 24/7 but guarantees no availability rate. Interruptions for maintenance may occur, preferably announced in advance.
8. Limitation of liability
The Publisher is liable for the proper performance of the Service under the conditions laid down by law. It does not in any way limit its liability in the event of personal injury, gross negligence or wilful misconduct, nor for a breach of an essential obligation of the contract.
For other harm, and except as regards consumer Users, whose statutory rights remain unaffected, the Publisher's liability is limited to direct and foreseeable damage.
The Publisher is not responsible for content published by Users, under the conditions laid down by Article 6 of Regulation (EU) 2022/2065, subject to the procedure described in article 4.5.
9. Termination
The User may close their account at any time from the settings. Paid subscriptions are subject to the Terms of Sale. The Publisher may terminate an account in the event of a serious breach of these Terms, after a formal notice has gone unheeded, except in an emergency.
10. Changes to the Terms
The Publisher may modify these Terms to reflect a change in the Service, a legislative or regulatory development, or a security requirement. Any substantial change is notified by email at least thirty days before it takes effect, stating what changes.
If you do not accept the new Terms, you may close your account free of charge before they take effect; the amounts corresponding to the unused subscription period are then refunded to you pro rata. Otherwise, continued use of the Service after that date constitutes acceptance.
The date of the last update appears at the top of this document. Previous versions are kept and provided on request.
11. Governing law and jurisdiction
These Terms are governed by French law, without that choice depriving a consumer User of the protection afforded to them by the mandatory provisions of the law of their country of residence.
A consumer User may bring proceedings, at their choice, before the courts of the place where they are domiciled or those of the Publisher's place of establishment (Article R. 631-3 of the French Consumer Code, Articles 17 to 19 of Regulation (EU) No 1215/2012). For business Users, and failing an amicable settlement, jurisdiction is given to the courts of Paris.
Consumer mediation. In accordance with Article L. 616-1 of the French Consumer Code, a consumer User may use a consumer mediator free of charge with a view to the amicable resolution of a dispute.
